The rules and conditions governing your use of the Agilify platform.
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Customer") and Agilify ("we", "us", or "our") governing your access to and use of the Agilify platform, products, and services. By signing up or using Agilify, you agree to these Terms.
By creating an account or using any Agilify service, you confirm that you are authorized to enter into this agreement on behalf of yourself or your organization, and that you accept these Terms in full. If you do not agree, do not use Agilify.
Agilify provides a cloud-based Business Operating System (BOS) and related professional services including AI implementation, tech consultation, digitalization services, data analysis, and custom app development. The specific features available to you depend on the plan you have subscribed to.
All prices are quoted in Indonesian Rupiah (IDR) and are inclusive of applicable taxes unless stated otherwise. Pricing is available on our pricing page and may be updated with 30 days' notice.
Subscriptions are billed monthly or annually in advance. Payment may be made via QRIS, GoPay, bank transfer, or other methods listed at checkout. Invoices are issued electronically to your registered email.
Eligible accounts may access a 14-day free trial. No credit card is required to start. At the end of the trial, your account will revert to a limited free tier unless you subscribe to a paid plan.
Monthly subscriptions are non-refundable. For annual subscriptions, a prorated refund may be issued if you cancel within the first 30 days. Professional services fees are non-refundable once work has commenced.
You agree not to use Agilify to:
You retain full ownership of all data you enter into Agilify ("Customer Data"). We do not claim any intellectual property rights over your Customer Data. You grant us a limited license to use your Customer Data solely to provide and improve the services. See our Privacy Policy for details on how we handle your data.
All rights in the Agilify platform, software, trademarks, and documentation are owned by us or our licensors. These Terms do not grant you any rights to our intellectual property except for the limited right to use the platform as described herein.
We target 99.5% monthly uptime for the BOS platform. Scheduled maintenance will be communicated at least 24 hours in advance. We are not liable for downtime caused by factors outside our control (force majeure, third-party outages, etc.).
Either party may terminate the subscription at any time. You may cancel from your account settings or by contacting us. We may suspend or terminate your account for breach of these Terms, non-payment, or misuse, with or without notice depending on severity. Upon termination, you may export your data within 30 days before it is deleted.
To the maximum extent permitted by Indonesian law, Agilify's total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through the courts of South Tangerang, Banten, Indonesia.
We may modify these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance of the revised Terms.
